Terms and conditions

Jyyna’s websites are owned, managed and operated by Anpartsselskabet JYYNA ApS, CVR no.: 38569244 (hereinafter referred to as the company). All content (including images and texts) found on the company website may only be reproduced with prior explicit permission.

Items are only sold online. Please contact us for special requests.

These Terms and Conditions apply to consumer agreements for the purchase of goods on jyyna.dk for delivery in Denmark, excluding Greenland and the Faroe Islands, unless otherwise expressly stated in the terms.

1.2 Delivery types

The following delivery types are available for items purchased on jyyna.dk:

Delivery with GLS, to ParcelShop

Please note that delivery is only made to addresses in Denmark, not Greenland and the Faroe Islands.

Delivery time is 2 – 5 business days from order processing until the goods are delivered to the desired address.

 

1.3 Order confirmation and acknowledgement of receipt of order

The Company’s advertising of goods is an invitation to make an offer, cf. section 9 of the Danish Contracts Act. A binding purchase agreement is therefore not concluded until the Company has accepted your order for goods.
This only occurs when you receive an order confirmation from the Company and the order is processed.

After you have placed an order, you will first receive an email confirmation that the company has received your order.
This first email will state which items you have ordered and at what price.
This email is not a binding order confirmation.

If the company can fulfill your order, you will subsequently receive a binding order confirmation by email when the goods are shipped from our warehouse or delivered by our supplier.

1.4 Payment and security

The company accepts payment with Dankort/VISA-Dankort, VISA, VISA Electron, Mastercard and JCB.
Payment will only be charged to your account when the item is shipped.

All amounts are in DKK.
Danish kroner and are incl.
VAT.

The company uses an approved payment server that encrypts all your card details with SSL (Secure Socket Layer) protocol and is PCI approved.

JYYNA does not store your credit card information.

1.5 Right of withdrawal

The cardholder has a 14-day return period, from receipt of the goods, on all non-food items if they are returned in unopened condition.
The period is calculated from the day the goods are received.

Return costs, when using the right of withdrawal, are at your own expense.

Cancellation must be reported to us no later than 14 days after the purchase and you must return the shipment within 14 days of notification.

The notice must be given by email to kundesrvice@jyyna.dk.
In the notification, you must clearly state that you wish to exercise your right of withdrawal.
You can also choose to use our standard withdrawal form and send it back to us.

If you choose to write to us by email in connection with the withdrawal of your purchase, we will immediately acknowledge receipt of the message by email.

If you cancel the purchase, we will refund all payments received from you, excluding delivery costs, without undue delay and in any event no later than 14 days from the date we have received notification of your decision to cancel the purchase.
We will make the refund using the same means of payment that you used for the original transaction.
We do not pay out to third parties.
You will not incur any fees as a result of the refund.
You must return the goods without undue delay and no later than 14 days from the date on which you informed us of the exercise of the right of withdrawal.
The deadline is met if you return the goods within the 14 days.

You are only liable for any deterioration in the value of the goods caused by handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

We may withhold the refund until we have received the goods back or you have provided proof of having returned the goods, whichever is the earliest.
When returning goods where delivery has been made as ‘Handed over at your curb’ or ‘Unloaded at your curb’, you must present a receipt from the haulier that he has picked up the goods.

Special cancellation rules apply to the purchase of certain types of goods;

1.5.1 No right of withdrawal on food products

There is no right of withdrawal for purchases of food/foodstuffs and other goods for current household consumption, as well as for the delivery of sealed goods that are not suitable for return for health protection or hygiene reasons and where the seal has been broken after delivery.

1.6 Complaints

When you buy from the company, you have a 24-month right to complain about faults or defects in the product from the time you received the product.
You must make a complaint within a reasonable time after you have discovered the fault or defect.
A timely, justified complaint means that you can either have the item repaired, receive a price reduction or a refund, depending on the specific situation.

The right of complaint lapses if the fault or defect is caused by the buyer, for example as a result of improper use or repair.

All complaints must be photo-documented with a clear photo.
You can attach them in an email sent to us at kontakt@jyyna.dk.
You can also contact customer service at kontakt@jyyna.dk, but we cannot consider a complaint without photos of the error.

You can also use the European Commission’s online complaint portal, which will mainly be relevant if you are a consumer residing outside Denmark.

1.7 Personal data

To be able to shop with the company, you must provide your name, address, phone no.
and e-mail address, pick-up store if applicable, and membership number if applicable.

The above data is stored with information about the goods you have purchased for 5 years from the end of the financial year to which the information relates, cf. section 10 of the Bookkeeping Act.

The Company will only disclose the information mentioned above that is strictly necessary for the supplier delivering the item(s) to you.
Address information is also disclosed to the company that is the carrier of the goods.
Disclosure of personal data will take place in accordance with the personal data legislation in force at any time.

The name, address, telephone number and, in some cases, e-mail address you provided when ordering will appear on the address label attached to the goods for delivery.

As a customer, you have the opportunity to gain insight into our registration of data about you, and you can object to a registration in accordance with the rules on this, cf. the Personal Data Processing Act.

If incorrect data has been registered, or if you have other objections, you can contact the same place.

You have the right to complain about the processing of information and data concerning you.
Complaints are filed with the Danish Data Protection Agency, cf. section 58(1) of the Personal Data Act.

1.8 CAVEATS

We make reservations for pricing errors, printing errors, stock errors and delivery errors from GLS.
If we receive your package back because you as a customer have not filled in your delivery address correctly or you have not picked up the item within the deadline, you are responsible for having the item sent again.

1.9 Choice of law and jurisdiction

Agreements on the purchase of goods on the company are subject to Danish law.
Any dispute shall be settled by the ordinary Danish courts.
